Acceptance
By using maxify.tech, the Maxia calculator, the agent workforce, or any related service (collectively, the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
The Service is operated by MAXIFY US LLC(“Maxify,” “we,” “us”).
Who can use it
- You must be at least 18 years old.
- If you use the Service on behalf of a company, you must have authority to bind that company.
- You may not use the Service if a prior account was suspended or terminated for cause.
What you can do
Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to use the Service for its intended purpose: requesting quotes, managing your installer pipeline, building proposals, and accessing your account.
What you can't do
You may not:
- Reverse-engineer, decompile, or extract source code from any part of the Service.
- Use the Service to send spam, run lead-generation campaigns we have not authorized, or violate the TCPA, CAN-SPAM, GDPR, or any applicable communication law.
- Scrape, crawl, or systematically extract data from the Service beyond what robots.txt permits.
- Resell access to the Service without a written reseller agreement.
- Upload utility bills, identity documents, or other personal data of any person without their explicit consent.
- Misrepresent your relationship to a homeowner you are quoting for.
Your content
You retain ownership of everything you upload (utility bills, photos, roof imagery, project notes). You grant us a worldwide, royalty-free license to process that content solely to deliver the Service, generate quotes, and improve our models using de-identified data.
We do not claim ownership of your data, do not sell it, and do not use it to train models for other customers without your consent.
Quotes and estimates
Quotes generated by Maxia 3.3 are good-faith estimates based on the data we receive (utility bill, roof imagery, current utility-rate tariffs). They are not binding contracts and may change after a physical site assessment.
The $15/month residual-bill target referenced in our marketing is a modeling target, not a guarantee. Actual residual bills vary with weather, consumption patterns, utility-rate changes, and equipment performance.
Payment terms
Free tiers exist and are documented at signup. Paid tiers are billed monthly or annually in advance. You can cancel at any time; cancellation takes effect at the end of the current billing period. We do not refund prorated unused time except where required by law.
Failed payments result in account suspension after a 14-day grace period. Data is retained for 90 days after suspension, then purged.
Voice agents and call recording
Our Twilio-based voice agent at (602) 559-1191 answers calls 24/7 and is never staffed by a human. Calls are recorded for quality review and transcribed by ElevenLabs. Transcripts are retained for 90 days.
By calling that number you consent to the recording. Single-party consent applies (Arizona, California one-party consent). Hang up if you do not consent.
Third-party services
We integrate with third-party services (Google Solar API, utility data providers, Stripe, etc.). Your use of those features is also governed by the third party's terms. We are not responsible for outages, errors, or changes to third-party services.
Intellectual property
The Service, including all software, design, content, and branding, is owned by Maxify Technologies or our licensors. You may not use our trademarks, logos, or trade dress without our written permission.
Termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that creates risk for us or other users. We will give written notice and a 14-day cure period when feasible.
You may terminate by deleting your account at any time. Provisions that should survive termination (sections 5, 10, 12, 13, 14) do.
Disclaimers
The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
We do not guarantee uninterrupted access. We do not guarantee that quotes will result in installation, financing approval, permit issuance, or any specific savings outcome.
Limitation of liability
To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) US $100.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The state and federal courts located in San Diego County, California have exclusive jurisdiction over any dispute.
No binding arbitration.We have intentionally not required you to waive your right to a jury trial. We believe that arbitration clauses on consumer terms are abusive, so we don't use them.
Changes to these Terms
We may update these Terms. If a change is material, we will email registered users at least 30 days before it takes effect and update the “Last updated” date above. Continued use after that date constitutes acceptance.
